The request for a deportation measure is aimed in particular at unaccompanied minors arriving from Central America. The petition that has arrived by letter to the Legislative was made by the USA Homeland Security Secretary, Kirstjen Nielsen.

According to the authorities, this permission will allow to attack the current migratory crisis, which has overflowed the capacity of the government agencies to manage it.

Donald Trump´s government asks Congress through this letter “authority to return [unaccompanied alien children] to their families and home countries in a safe and orderly manner if they have no legal right to stay”.

“Currently, we can reunite many unaccompanied minors from Mexico with their families and return them home, when appropriate, but we are legally unable to do so for children from non-contiguous countries,” Nielsen explained .

“We need the authority to treat all arriving migrant children equally,” she adds.

Permanent detention until the trial

The Trump administration, in addition to permission to deport Central American children, will also ask authority to hold families looking for asylum, in detention until their immigration court proceedings are resolved.

At present, the detention of minors for more than 20 days is not allowed according to a 1997 judicial agreement known as “Flores”. Families with children are released while their applications are being studied.

Nielsen also asked Congress to authorize people interested in applying for asylum to complete paperwork in their countries of origin in Central America instead of taking “the dangerous journey north.”

According to Homeland Security, immigrants arrival to the United States along the southern border are at their highest levels in the last thirteen years and in March will exceed 100 thousand people.

In contrast to past migration flows, Central American asylum seekers arriving with their families and unaccompanied minors from the Northern Triangle are more relevant.

In her letter to Congress, Nielsen described as unsustainable the level of “vulnerable populations” who arrive in large groups at the border and said that their agents do not have the resources to manage them.
