Although cannabis became legal in New Jersey on Friday morning, January 1, all the laws on the books outlawing marijuana possession, use, and sales are still in effect. This means someone possessing marijuana can technically be jailed for a year, according to NORML. And this is happening after legalization.

“Until there is a law establishing a legal cannabis market, the existing state laws regarding marijuana remain in effect,” Peter Aseltine, a spokesman for Attorney General Gurbir Grewal said on Thursday.

According to a Forbes report, the only legal “protection” that cannabis users in New Jersey currently enjoy is a polite request from the state attorney general, who has asked police to please not arrest anyone for weed.

On the politics side, there is an eleventh-hour breakdown in the lawmaking process. But on the law side, there is a questionable use of language. “Marijuana” is still illegal in New Jersey no matter what. “Cannabis,” on the other hand, is okay, but only in certain situations, says Forbes journalist Chris Roberts.

Amendment without details

Though Question 1 amended the state constitution and was interpreted by both voters and the media as “legalizing marijuana,” the amendment provided no details, like how much adults could possess, and where they could get it. All those details would come later in “enabling legislation,” a package of laws that would also outline broad rules controlling a future commercial cannabis industry.

So January 1, the effective date, came and went without any laws in place for citizens to enjoy.

You can read: Polls show New Jersey voters have strong support for Marijuana legalization

On Nov. 25, a few weeks after the legalization vote, while lawmakers were still debating the finer points of where to divide the cannabis sales tax revenue, Grewal directed all local courts to seek adjournment of any pending or future court cases involving marijuana possession.

That adjournment request, essentially a moratorium on enforcing petty marijuana laws, is supposed to remain in effect until January 25.

Until then, police have the legal right to arrest someone for marijuana and take whatever weed they have on them. But if they do, prosecutors will not be able to do anything with the case.

It is sort of unclear whether there is now a constitutional right to possess cannabis,” said Amol Sinha, the executive director of the American Civil Liberties Union of New Jersey, one of the main supporters of the political campaign that convinced voters to approve Question 1.

New Jersey has become one of the latest states to adopt cannabis telemedicine measures, allowing residents to get approval for medical cannabis and for other controlled substances digitally. Laweekly provides the details.

According to state law, the doctor must discuss the risks and benefits of opiates and other alternatives during these video meetings. They must also provide the necessary information on medical cannabis, check in with a Prescription Monitoring Program for what they prescribe and supply a maximum supply of 5 days when it comes to acute pain diagnoses. The meetings must also have video and audio enabled from all participants and must be “consistent with the standard of care.”

Despite all the bureaucratic obstacles, Cannabis telemedicine is growing. Telemedicine has proven to be a safe option during the pandemic. It gives patients the chance to get the medical advice they need while saving money, time and stress.

You can read: Recreational marijuana legalization will depend on New Jersey voters

“New Jersey health care practices are again offering in-person services, but telehealth remains an important option for patients and providers,” said Attorney General Gurbir Grewal. “Today, we’re making it easier for patients to choose telehealth services for any reason, including to avoid an in-person visit due to the continuing risk of COVID-19.”

While telemedicine is a simple way of eliminating in-person visits to hospitals and doctors offices and, thus, preventing the spread of the virus, New Jersey’s new ruling has to follow the DEA’s standards.

Due to the pandemic, the DEA has allowed a temporary waiver that allows medical practitioners to supply medical cannabis through video but doctors will likely be extra careful when prescribing these, ensuring that the condition being treated fits neatly into their state’s medical cannabis program.

Other states in the U.S. have implemented cannabis telemedicine, not only due to the pandemic, but also in hopes of facilitating virtual visits for patients who are in no condition to visit a doctor’s office or who live far away from their physician.

New Jersey’s sanctuary immigration policies were considered “unlawful” by the U.S. Department of Justice which filed a lawsuit against them under the Supremacy Clause of the U.S. Constitution.

The Justice Department said Tuesday that New Jersey officials allegedly failed to give information regarding the release date of detained individuals who had been charged with or convicted of a crime.

You can read: Five days ICE raid in NJ ends with the arrest of 115 undocumented immigrants

“New Jersey’s decision to obstruct federal immigration enforcement by refusing to provide such information is unlawful under the Supremacy Clause of the U.S. Constitution,” the DOJ argues.

U.S. Attorney General William Barr said that the state’s policy is ilegal. He claims that it obstructs federal immigration enforcement.

“Today is a significant escalation in the federal government’s efforts to confront the resistance of sanctuary cities,” U.S. Attorney General William Barr said. “But by no means do the efforts outlined above signify the culmination of our fight to ensure the rule of law, to defend the Constitution and to keep Americans safe.”

The complaint challenges New Jersey Attorney General Gurbir Grewal’s “Immigrant Trust Directive”. This directive prevents state law enforcement officials from sharing information with U.S. Immigration and Customs Enforcement about the immigration status and release date of detained individuals.

You can read: Trump announces rule that restricts legal immigration for low-income people

It also requires state and local law enforcement to inform a person who is detained if the U.S. Immigration and Customs Enforcement (ICE )has filed an immigration detainer request for the individual.

The Justice Department also argued in that due to New Jersey’s law enforcement directive there were less arrests during year 2019 than in 2018.

However, Grewad discarded the lawsuit as a simple electoral movement in which President Trump places politi cal interests above legitimate citizen needs.

“Once again, the Trump Administration is sacrificing public safety for political expedience,” Grewal said in a statement. “It’s no surprise that the President, facing re-election, has suddenly decided to challenge a policy we first announced in 2018. What’s disappointing is that my former colleagues at the Justice Department have agreed to go along with this election year stunt.”

He added that the continuity of his job will be maintained. “Thankfully, nothing about today’s lawsuit changes our work on the ground. While the President grandstands, we’re focused on protecting the nine million residents of New Jersey.”
