										<content:encoded><![CDATA[<p><strong>According to the Center for Justice and International Law (Cejil), the United States would be deepening &#8220;human rights violations&#8221; of people &#8220;in need of international protection&#8221; with the new authorization that allows the detention of undocumented families and children for longer than current standards establish.</strong></p>
<p><strong> </strong>Cejil is a group of human rights defenders who work to reduce inequality, discrimination and violence by strengthening democracies, protecting and promoting human rights and fighting impunity in the region.</p>
<p><strong>Marcela Martino, deputy director of Cejil, an NGO with consultative status before the Organization of American States (OAS) founded in 1991, said on the subject that “international law is clear: migrant children cannot be detained for any reason”.</strong></p>
<p><strong> </strong>As reported by several media reports, on Wednesday, the U.S. government announced a plan to detain undocumented families and children longer than current regulations allow, even indefinitely, in an attempt to hold the flood of Central America undocumented immigrants.</p>
<p><strong>The Department of Homeland Security (DHS) explained in a statement that the decision, published in the Federal Register tomorrow, will take effect in 60 days. The resolution is intended to put an end to the so-called Flores Agreement, which has established protection measures for unaccompanied migrant children since 1997, ranging from social benefits to maximum periods of detention.</strong></p>
<p>In addition, the Department of Immigration and Customs Enforcement (ICE) said they investigate &#8220;child trafficking and fraudulent documents used,&#8221; which, they say, take advantage of &#8220;legal loopholes in family migration.”</p>
<p>Kevin McAleenan, acting DHS secretary, explained on Twitter that <strong>&#8220;today&#8217;s action addresses a court-imposed weakness in immigration law that prevented DHS from detaining a family together for more than 20 days and codifies critical commitments on the conditions for children in Federal care.”</strong></p>
<p><strong> </strong>The Deputy Director of Cejil warned that &#8220;if the measure announced by the Trump Administration comes into effect, which adds to its efforts to stop migration across the Southern border at all costs, human rights violations against migrants and those in need of international protection will deepen&#8221;.</p>
<p><strong>The deputy director of Cejil explained that those who will be subject to these measures “are children coming from situations of high risk and violence”.</strong></p>
<p><strong> </strong>The Cejil directive, an entity that is also a consultant to the UN and the African Commission on Human Rights, added that &#8220;it is imperative to safeguard the best interests of children and their physical and mental integrity, as well as the full observance of their human rights.”</p>
<p>The current number of arrests on the southern border is impressive. 132,870 arrests of undocumented immigrants at the border with Mexico were reported, of which 84,491 corresponded to family groups that the authorities define as individuals accompanied by a minor, a parent or a legal guardian.</p>

<p>Cejil es un grupo de defensores de derechos humanos que trabaja para reducir la desigualdad, la discriminación y la violencia, a través del fortalecimiento de las democracias, la protección y promoción de los derechos humanos y el combate contra la impunidad imperante en la región.</p>
<p><strong>Marcela Martino, subdirectora del Cejil, una ONG consultora ante la Organización de Estados Americanos (OEA) fundada en 1991, dijo sobre el particular que &#8220;el derecho internacional es claro: la niñez migrante no puede ser detenida bajo ningún motivo&#8221;.</strong></p>

<p>Como ha sido divulgado por varios medios de comunicación, el Gobierno de Estados Unidos anunció este miércoles un plan destinado a permitir la detención de las familias y niños indocumentados durante más tiempo de lo que permiten las normas actuales, incluso indefinidamente, con el fin de frenar la avalancha de inmigrantes sin papeles que llegan de Centroamérica.</p>
<p><strong>El Departamento de Seguridad Nacional (DHS) explicó en un comunicado que la decisión, que será publicada en el Registro Federal mañana, entrará en vigor en 60 días. La resolución está destinada a poner fin al llamado Acuerdo Flores, que desde 1997 establece medidas de protección para los niños migrantes no acompañados, desde prestaciones sociales a períodos de detención máximos.</strong></p>
<p>Además la Oficina de Inmigración y Control de Aduanas (ICE, en inglés) indicó que investigan &#8220;el tráfico de niños y los documentos fraudulentos usados&#8221;, que, aseguran, aprovechan los &#8220;vacíos legales en la migración de las familias&#8221;.</p>
<p>Kevin McAleenan, secretario del DHS en funciones, explicó a través de su cuenta en Twitter, que <strong>&#8220;la acción de hoy aborda una debilidad impuesta por los tribunales a la ley de inmigración, que impidió que el DHS detuviera a familias unidas durante más de 20 días y codifica compromisos críticos sobre las condiciones para los menores bajo cuidado federal&#8221;.</strong></p>

<p>La subdirectora del Cejil advirtió que &#8220;de entrar en vigor la medida anunciada por la Administración Trump, que se suma a sus esfuerzos por detener la migración por la frontera sur a toda costa, se profundizarán las violaciones de derechos humanos en contra de personas migrantes y aquellas personas en necesidad de protección internacional&#8221;.</p>
<p><strong>La subdirectora del Cejil recordó que quienes serán sujetos de esas medidas &#8220;son niños y niñas provenientes de situaciones de alto riesgo y violencia&#8221;.</strong></p>
<p>Añadió la directiva del Cejil, un ente que también es consultor ante la ONU y la Comisión Africana de Derechos Humanos, que &#8220;es imperativo velar por el interés superior de la niñez y salvaguardar su integridad física y mental, al igual que la plena vigencia de sus derechos humanos&#8221;.</p>
<p>Las cifras actuales de detenciones en la frontera sur son de récord. En se reportó 132 mil 870 detenciones de inmigrantes indocumentados en la frontera con México, de las que 84 mil 491 correspondieron a unidades familiares que las autoridades definen como individuos acompañados de un menor, un progenitor o un tutor legal.</p>
